Distance Selling Contract

This contract has been drawn up in accordance with the Regulation on Distance Contracts published in the Official Gazette dated 06.03.2013 and numbered 27866, based on the obligation to make a contract for online sales, and the articles are as follows.

ARTICLE 1 – SUBJECT

The subject of this contract is the Law on Consumer Protection No. 6502 published in the Official Gazette dated 28.11.2013 and numbered 28835 regarding the sale and delivery of the product that the SELLER sells to the BUYER and the Distance Contracts published in the Official Gazette No. 27866 dated 06.03.2013. It covers the rights and obligations of the parties in accordance with the provisions of the regulation.

ARTICLE 2.2 – BUYER INFORMATION

A person who is a member of the artcraftca.com shopping site as a customer. While becoming a member, the title, address and contact information declared by the customer are taken as basis.

ARTICLE 3 – CONTRACT SUBJECT PRODUCT INFORMATION

It consists of the type, quantity, brand / model, color, number, sales price, payment method of the good / product / service, and the information at the time the order is finalized.

ARTICLE 4 – GENERAL PROVISIONS

4.1 – The BUYER accepts, declares in advance and in full that he / she has carefully, thoroughly, completely and completely read all the preliminary information regarding the basic characteristics, sales price and payment method and delivery of the product or products specified in Article 3, understands its content and approves its provisions. It is deemed to have committed and accepts, declares and undertakes in advance and in full that it gives the necessary confirmation in electronic environment.

4.2 – The product or products subject to the contract are delivered to the BUYER or the person / organization at the address indicated in the preliminary information, depending on the distance of the BUYER’s place of residence for each product, provided that the legal 30-day period does not exceed. This period may be extended for a maximum of 10 days, provided that the BUYER is notified beforehand.

4.3 – If the product subject to the contract is to be delivered to another person / organization other than the BUYER, CA DESIGNSTUDIO / Halit Cumhur Aygün cannot be held responsible for the non-acceptance of the delivery by the person / organization to be delivered.

4.4 – CA DESIGNSTUDIO / Halit Cumhur Aygün is responsible for delivering the product subject to the contract in a sound, complete, in accordance with the specifications specified in the order, and with warranty documents and user manuals, if any.

4.5 – For the delivery of the product subject to the contract, the price must be paid in the form of payment preferred by the BUYER. CA DESIGNSTUDIO / Halit Cumhur Aygün is deemed to be free from the obligation to deliver the product if, for any reason, the product price is not paid or canceled in bank records.

4.6- After the delivery of the product, if the relevant bank or financial institution does not pay the price of the product on behalf of CA DESIGNSTUDIO / Halit Cumhur Aygün, due to the use of the credit card belonging to the BUYER by unauthorized persons without the fault of the BUYER It is obligatory to send the product to CA DESIGNSTUDIO / Halit Cumhur Aygün contact address (s) within 3 calendar days. In this case, shipping costs belong to the BUYER.

4.7- CA DESIGNSTUDIO / Halit Cumhur Aygün is obliged to notify the BUYER of the situation if the contractual product cannot be delivered within due time due to force majeure or extraordinary circumstances such as adverse weather conditions that prevent transportation. In this case, the BUYER may use one of the rights to cancel the order, to replace the product subject to the contract with a precedent, and / or to postpone the delivery until the situation that prevents the delivery period is eliminated. In case the BUYER cancels the order, the amount paid will be paid to him in cash and in lump sum within 10 business days.

4.8- This contract becomes valid when the order is confirmed and accepted by the BUYER and finalized.

ARTICLE 5 – RIGHT TO WITHDRAWAL

The BUYER has the right to withdraw within 7 days from the delivery of the contracted product to him or to the person / organization at the address indicated. In order to use the right of withdrawal, it is necessary to notify the CA DESIGNSTUDIO / Halit Cumhur Aygün communication channels by e-mail, fax and / or telephone and the product must not be used in accordance with the provisions of the applicable law. In the event that this right is exercised, it is obligatory to return the original invoice and the copy of the cargo delivery report indicating that the product delivered to the 3rd party or the BUYER has been sent to CA DESIGNSTUDIO / Halit Cumhur Aygün contact addresses. The product price is returned to the BUYER within 7 days following the receipt of these documents. If the original invoice is not sent, K.D.V. and other legal obligations, if any, cannot be returned. The shipping cost of the returned product due to the right of withdrawal is paid by the BUYER. In addition, the consumer cannot use the right of withdrawal for the goods produced in accordance with the special requests and demands of the consumer or made personalized by making changes or additions.
If the payment is made by credit card or a similar payment card, the consumer may request the cancellation of the payment transaction on the grounds that the card is used against his / her consent and illegally. In this case, the issuing institution returns the payment amount to the consumer within 10 days from the notification of the objection.

Consumer Arbitration Committees and Consumer Courts in CA DESIGNSTUDIO / Halit Cumhur Aygün settlement are authorized in the implementation of this contract up to the value announced by the Ministry of Industry and Trade.

In case the order is concluded, the BUYER will be deemed to have accepted all the terms of this contract.
